These Terms of Service ("Terms") are the rules for using www.eagleagency.ai (the "Site"), which is run by Eagle AI Agency LLC, a Virginia limited liability company based in Norfolk, Virginia ("Eagle AI Agency," "we," "us"). By using the Site, filling out a form, or booking a call, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Who we are and what the Site is for

We run sales and marketing for small businesses: AI-assisted sales outreach (email, LinkedIn, and AI SDR), marketing content, website design and SEO, AI integration and agent deployment, and recruiting services. The Site describes those services, offers free assessments, and lets you book a call with us. We serve businesses in the United States.

2. Using the Site

You can use the Site for its intended purpose: learning about our services, requesting an assessment, and getting in touch. When you do, you agree to:

  • Give us accurate information, and only information you have the right to share.
  • Only submit a website for an assessment or SEO check if it is yours or you are authorized to request it.
  • Not use the Site for anything unlawful, misleading, or harmful.
  • Not try to break, overload, probe, or get around the security of the Site or our forms.
  • Not scrape, copy, or automate submissions to the Site, or use it to build a competing product.
  • Not submit spam, malware, or other people's personal information without permission.

We may suspend or block access to the Site or any form for anyone who breaks these Terms.

3. Free assessments

We offer a free AI assessment, a free recruiting assessment, and a free SEO check. They are free, with no obligation to buy anything.

  • They are informational only. Each assessment is based on the limited information you give us and a read of publicly available pages on your site at that moment. It is our honest read, not a full analysis of your business.
  • They are not guarantees. We do not promise any particular result from following an assessment, including more leads, sales, hires, revenue, search rankings, or AI citations. Results depend on many things outside our control.
  • They are not professional advice. Assessments are not legal, financial, tax, accounting, employment, or HR advice. Talk to a qualified professional for those.
  • AI is used to prepare them. Reports are written with the help of AI tools and can contain mistakes. Use your own judgment before acting on them.
  • When we say you are guaranteed a written report, we mean we will provide one, not that its contents are guaranteed to be right for your situation.

We may change, limit, or stop offering any free assessment at any time.

4. Calls and communications

When you book a call or submit a form, you agree that we may contact you by email or phone about your request, and by text if you opted in, as described in our Privacy Policy. You can opt out of texts at any time by replying STOP, and out of emails using the unsubscribe link or by emailing matt@eagleagency.ai. Consent to marketing texts is not a condition of buying anything from us.

5. Paid engagements

Nothing on the Site is a binding offer, and the Site does not create a client relationship. Every paid engagement is governed by a separate written agreement (such as a proposal, statement of work, or services agreement) signed or accepted by both sides. If that agreement conflicts with these Terms, the agreement wins. Any prices, billing, renewal, cancellation and refund terms that apply to you are the ones in your agreement or shown at checkout.

6. Intellectual property

The Site and everything on it (text, design, graphics, logos, blog posts, assessment questions, and report formats) belong to Eagle AI Agency or our licensors and are protected by law. You may view and share pages from the Site for personal or internal business use. You may not copy, republish, sell, or create derivative works from the Site's content without our written permission. "Eagle AI Agency" and our logo are our trademarks.

You keep ownership of the information you submit to us. You give us permission to use it to provide what you asked for and to run and improve our services, as described in our Privacy Policy.

Your assessment report is yours to use for your business. Ownership of work we create in a paid engagement is set out in that engagement's written agreement.

If you send us ideas or feedback, we are free to use them without any obligation to you.

7. Third-party services and links

The Site uses and links to services run by other companies, such as the HighLevel (LeadConnector) booking calendar and our social media profiles. Those services have their own terms and privacy policies, and we are not responsible for them.

8. Disclaimers

The Site, its content, and the free assessments are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Site will always be available, error-free, or secure. Blog posts and other content are general information and may become out of date.

9. Limitation of liability

To the fullest extent the law allows:

  • Eagle AI Agency and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from your use of the Site or the free assessments, even if we were told they were possible.
  • Our total liability for any claim relating to the Site or the free assessments is limited to one hundred US dollars (US $100).

Liability for paid services is governed by your written agreement. Some states do not allow certain limitations, so some of these may not apply to you.

10. Indemnity

If you misuse the Site or break these Terms and someone brings a claim against us because of it, you agree to cover our reasonable losses and costs, including reasonable attorneys' fees.

11. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute relating to the Site or these Terms will be brought only in the state or federal courts located in Norfolk, Virginia, and you and we agree to the jurisdiction of those courts. Before filing anything, please email us at matt@eagleagency.ai so we can try to sort it out informally.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top. Using the Site after an update means you accept the updated Terms.

13. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision right away, we have not given up the right to enforce it later. These Terms and our Privacy Policy are the full agreement between you and us about the Site; your written agreement covers any paid work. You may not transfer your rights under these Terms; we may transfer ours as part of a reorganization, merger, or sale.
